Understanding the Hague Congention

If you're considering adopting internationally, you'll need to know all about the Hague Convention, as you will be directly affected by it. For starters, the full name of the Hague Convention is The Hague Adoption Convention on the Protection of Children and Co-operation in Respect of Inter-Country Adoption. The name alone is pretty self-explanatory, but let's get more in-depth. Take a look at the important facts below.

  • Held in the Netherlands in 1993.
  • During the convention, involved countries agreed upon international adoption standards that would best benefit and safeguard the children involved.
  • The United States officially signed its agreement of the Hague Convention in 1994.
  • But it wasn't until 2008 that the United States fully implemented the Hague Convention guidelines.
  • If you're adopting within the United States, you are required to follow those established guidelines.
  • Not all countries have agreed to the Hague Convention, so there are convention procedures and non-convention procedures when adopting internationally, depending on the country.
  • The convention guidelines are not just to protect the children; they're also in place to protect adoptive parents.
  • One main goal of the Hague Convention is to limit or abolish black market adoptions, child abductions, and human trafficking.
  • Under the Hague Convention, all adopted children must first be found eligible for adoption. One criterion is that the country must first try to place the child in his/her country. If placement cannot be made, then intercountry adoption is the next viable option.
  • Within Hague Convention countries, adoption agencies must be properly accredited. This helps ensure that adoption agencies are honest, transparent, and law-abiding. This doesn't catch all fraudulent or dishonest agencies, but it helps to limit that number.
  • Accredited adoption agencies must provide itemized lists of fees and expenses of each adoption. This will allow adoptive parents to be fully informed at the start of the process.
  • Some convention countries include Australia, China, South Africa, Mexico, and the United Kingdom.

Although these facts aren't all-encompassing, it's a great place to start if you're thinking about international adoption. The Hague Convention helps to make the international adoption process better streamlined and safer for all involved. Before you begin the adoption process, make sure you research the guidelines and requirements of your home country and of the country you're hoping to adopt from. The more informed you are in the beginning, the easier the adoption path.
